Overview of Virginia’s 2021 General Assembly Session

The Virginia General Assembly held a Special Session in 2020 to address Criminal Justice issues. That session was productive and produced a lot of legislation.

The General Assembly returned this January in their General Session and picked right up where they left off, passing a high volume of laws that impact the Criminal Justice System in Virginia.

This includes:

  • Marijuana Legalization
  • Reclassifying Robbery based on the severity of the actual offense
  • Repealing Felony Petit Larceny
  • Repealing the Death Penalty
  • Limits on night-time and “No-Knock” Warrants
  • Repealing the current presumptions against Bond

As the General Assembly continues to address Criminal Justice issues, it is important for Defense Attorneys to be aware of these changes how they affect the practice of law.
